1. Agreement to terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and Blue Ocean Club LLC ("Blue Ocean Club", "we", "us", "our") governing your access to and use of our website at blueoceanclub.com and our yacht charter services. By accessing or using our website or services, you agree to be bound by these Terms. If you do not agree, you may not use our services.
2. About our services
Blue Ocean Club is a curated yacht charter atelier that connects clients with private yacht charter opportunities across the Mediterranean, Caribbean, Bahamas and other destinations. We act as an intermediary between charter clients and yacht owners or fleet operators. We do not own or operate yachts directly unless expressly stated.
3. User accounts and eligibility
You must be at least 18 years old to use our services. When creating an account or submitting an enquiry, you agree to provide accurate, current and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
4. Charter bookings and payments
All charter bookings are subject to availability, owner approval and execution of a separate charter agreement. Pricing displayed on our website is indicative and subject to confirmation. A deposit is typically required to secure a booking, with the balance due before embarkation. Cancellation terms vary by yacht and are specified in the individual charter agreement.
5. Intellectual property
All content on this website — including text, images, logos, videos, design and software — is the property of Blue Ocean Club LLC or our licensors and is protected by copyright, trademark and other intellectual property laws. You may not reproduce, distribute, modify or create derivative works without our prior written consent.
6. Acceptable use
You agree not to use our website or services for any unlawful purpose, to transmit malicious software, to attempt unauthorized access to our systems, to scrape or harvest data, or to interfere with other users' access. We reserve the right to suspend or terminate access for violations.
7. Disclaimers
Our website and services are provided "as is" without warranties of any kind, express or implied. We do not guarantee that yacht specifications, availability or pricing will be accurate at all times. Charter experiences depend on weather, sea conditions and other factors outside our control. We are not liable for indirect, incidental or consequential damages.
8. Limitation of liability
To the fullest extent permitted by law, Blue Ocean Club LLC's total liability arising from or relating to these Terms or your use of our services shall not exceed the total amount you paid to us in the twelve (12) months preceding the claim, or $1,000 USD, whichever is greater.
9. Indemnification
You agree to indemnify and hold harmless Blue Ocean Club LLC and its officers, directors, employees and agents from any claims, damages, losses or expenses arising from your use of our services, your violation of these Terms, or your infringement of any third-party rights.
10. Governing law and dispute resolution
These Terms are governed by the laws of the State of New Mexico, United States, without regard to conflict of law principles. Any dispute arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in Albuquerque, New Mexico, under the rules of the American Arbitration Association.
11. Changes to these terms
We may modify these Terms at any time. Material changes will be notified by posting the updated Terms on this page with a revised effective date. Your continued use of our services after such changes constitutes acceptance of the updated Terms.
